The following terms and conditions (the “Terms”)govern the relationship between TKM Plumbing and Heating Ltd. dba Service Pro Plumbing and Heating (“Service Pro”) and its customers (the “Customer”) when providing services related to plumbing, heating, gas fitting, or any other service provided by Service Pro (the “Services”).

Estimates

Estimates for Services are based on labour and materials costs as of the date of the estimate (an “Estimate”). If an Estimate is not accepted by the Customer within 30 days of it being issued, Service Pro reserves the right to amend the Estimate to reflect current costs of labour and materials. Service Pro may, in certain circumstances, require the Customer to provide a deposit when an Estimate is accepted in order to purchase parts or materials. Deposits used to purchase parts or materials are non-refundable.

Appointments

Following a request by the Customer, Service Pro will book an appointment or appointments for the Services (an “Appointment”). Service Pro may change the start time or date of an Appointment, or cancel an Appointment, for any reason and without penalty. The Customer acknowledges that Appointments and Services may be delayed or cancelled due to circumstances beyond Service Pro’s control.

Cancellation

Once a Customer has booked an Appointment, the Customer may cancel that Appointment without penalty up to 48 hours prior to the Appointment. If the Customer cancels the Appointment within 48 hours of the booked Appointment, Service Pro will charge the Customer a $100.00 call-out fee.

Services and Warranty

Service Pro will complete the Services in accordance with the Estimate and any changes made pursuant to these Terms, and in a good and workmanlike manner. Service Pro will remedy any deficiencies in its workmanship to a reasonable industry standard. If Service Pro has remedied such a deficiency to that standard, it will have no further liability to the Customer. Should the Customer require any subsequent service calls with respect to the same deficiency, the Customer will be liable to Service Pro for the costs thereof.

Where equipment or products are installed as part of the Services, any deficiency or failure of that equipment or those products will be dealt with solely between the Customer and the manufacturer under the manufacturer’s warranty, and Service Pro will not be liable to the Customer therefor. If the Customer employs Service Pro to perform Services related to any manufacturer’s warranty (re-installation or maintenance, for example), the Customer will pay Service Pro for the cost to provide those Services, including labour and the costs of any parts and materials not covered by the manufacturer’s warranty.

Service Pro will not be liable to the Customer for any deficiencies in the Services that arise from pre-existing conditions unknown to Service Pro at the time the Services commence.

Notwithstanding anything else contained in these Terms or in any agreement between Service Pro and the Customer, Service Pro will not be liable to the Customer for any amount in excess of the amount that the Customer paid Service Pro for the Services.

Scope of Work

The scope of work for the Services will be in accordance with the Estimate, provided that Service Pro will not be responsible for circumstances unknown or unforeseen to Service Pro at the time of the Estimate, and reserves the right to change the Estimate in that event. At any time following the acceptance of an Estimate, the Customer may request changes to the Services to be performed. The requested changes must be agreed to in writing and signed by both Service Pro and the Customer (a “Change Order”). Service Pro will have no obligation to perform additional Services in the absence of a signed Change Order. Any additional costs resulting from a Change Order are the responsibility of the Customer. The Customer acknowledges that changes to the Services may result in re-scheduling and delays, and that Service Pro will not be liable for any such delay.

Payment and Price

Service Pro will issue an invoice for the Services plus applicable taxes to the Customer on the day of the Appointment or shortly thereafter (an “Invoice”). The amount of an Invoice is due and payable by the Customer within 30 calendar days from the date of the Invoice. All payments in arrears will bear interest at a rate of 3% per month, calculated and compounded monthly until paid in full.

Service Pro accepts Visa, Mastercard, American Express, debit (at the Service Pro office location), cash, cheque and e-transfer (admin@serviceproplumbers.ca). We charge a 3% convenience fee for credit card transactions over $2,000.00.

Service Pro may withhold its Services immediately and indefinitely if the Customer does not make payments in accordance with these Terms.

Intellectual Property

Service Pro will retain the exclusive right, title and interest in intellectual property created (including but not limited to job designs, sketches, blueprints, and all work that be the subject matter of copyright, trademark or patent protection) in the performance of the Services (the “Intellectual Property”). The Customer will not use or disclose the Intellectual Property other than for purposes directly related to the Services.

Governing Law

These Terms will be construed, enforced in accordance with, and governed by the laws of the Province of British Columbia.
